Understanding Alternative Dispute Resolution
This one-day course provides participants with an overview of alternatives to court adjudication for resolving disputes. Participants will discuss negotiation, mediation and arbitration as employed in Arizona and other jurisdictions. Instructors use role playing, simulations, videos, seasoned mediator coaches and interactive discussions.
The program is designed to provide an understanding of the breadth of ADR options available. Furthermore, we will take an in-depth look at the differences between two commonly used ADR options: arbitration and mediation. It is appropriate for anyone who wishes to understand the various options available to resolving disputes outside of court. Attendees often include lawyers, paralegals, mediators, therapists, business professionals and human resource executives.
Your registration fee not only provides you with training, but you will also receive our publication, Understanding Alternative Dispute Resolution. This practical handbook lists model rules and standards, sample agreements, sample forms, a list of suggested reading and a variety of other valuable information, handouts, and assessments.
Participants who complete the program receive a Certificate of Completion at the end of the course. Attorneys: this course may qualify for up to 6 CLEs which may fulfill professional responsibility requirements.
Training materials are included in the cost of registration. We will have working lunches. An optional catered lunch is available or you may bring your own.
While there is no advanced reading requirement, we encourage you to consider some of the selections from our resource list.
Course Syllabus
General Learning Objectives: By the end of the course, students should be able to:
- Understand and evaluate the use of various processes and techniques to resolve a dispute without court adjudication.
- Identify and understand the various choices for dispute resolution other than adjudication.
- Describe applications of at least three alternative methods to resolve disputes- negotiation, mediation and arbitration.
Course Participation:
Since this is a “learn by doing” class, and since class learning depends on a group experience, your attendance and participation is essential. Please be considerate of your classmates and instructor as we build a classroom community during this course. Behaviors such as arriving late, leaving early, ringing cell phones, pagers cause disruptions which inhibit learning for all participants.

From time to time it may be valuable to make changes in course policies or schedules. Therefore, we reserve the right to modify any of this syllabus during the course. It is each participant’s responsibility to be aware of any such changes as they are announced.
